Enacted law: synthetic performers in advertisements

New York General Business Law § 396-b requires a person commercially producing or creating an advertisement to conspicuously disclose a synthetic performer when the person has actual knowledge of its use. The definition covers a generated visual or audiovisual human performer who is not recognizable as an identifiable natural performer. Civil penalties are $1,000 for a first violation and $5,000 for later violations.

Exceptions include audio advertisements, AI used solely for language translation, and promotions for expressive works when the synthetic performer’s use is consistent with the work. The statute also exempts advertising media that publish or disseminate the advertisement.

McDermott Will & Schulte’s June 9, 2026 analysis reports that the law took effect that day and recommends reviewing advertising workflows and vendor agreements to identify synthetic performers and allocate disclosure responsibilities.

Proposed legislation

• S10731 — frontier-AI oversight expansion — introduced October 28, 2026; proposes independent examiners, risk assessments and computing-power controls; referred to Rules.

Stricken proposals

New York S10701, the TERMINATOR Act, was introduced and referred to Rules on September 18, 2026. The Senate action record also lists “RECOMMIT, ENACTING CLAUSE STRICKEN” that day, and its current status is Stricken. The proposal concerned independent safety evaluations, monitoring, reporting and risk mitigation for frontier AI models.

Enforcement

AI whistleblower alert

On September 17, 2026, Attorney General Letitia James invited reports of potentially unlawful or unsafe AI development. The portal supports anonymous two-way communications but does not guarantee confidentiality of submitted content. See September 17 digest coverage.

Deepfake-domain seizures

On September 14, 2026, Manhattan prosecutors announced court-authorized seizures of 12 domains distributing nonconsensual sexual deepfakes; the investigation remained ongoing. See September 14 digest coverage.

Local oversight

September 25 AI-safety proposal package

On September 25, 2026, the New York City Council announced eight new AI-safety proposals for consideration, alongside two bills introduced earlier in 2026. Its release scheduled a Committee of the Whole hearing for October 5. The proposals are pending; the announcement did not enact their requirements. See the September 27 digest.

On September 28, Council Speaker Julie Menin issued a subpoena directing SpaceXAI to appear at the October 5 hearing. The Council said OpenAI, Anthropic, Google and Meta agreed to testify under oath. It may ask a state court to enforce the subpoena if SpaceXAI does not comply. The hearing will examine the pending proposal package. See the September 29 digest.

October 8 formal introductions

The Council formally introduced all eight new bills on October 8, 2026, following the October 5 preconsideration hearing. The action records list them in committee. Their numbered introductions and proposed subjects are:

• Int 1100-2026 — third-party model validation and human shut-down capability, with civil penalties for specified violations.
• Int 1101-2026 — a civilian complaint process and a share of recovered penalties for qualifying complainants.
• Int 1116-2026 — a private cause of action for foreseeable harm from third-party misuse where a model provider failed to implement reasonable safeguards.
• Int 1109-2026 — city-contractor and agency reporting of specified AI safety incidents to Cyber Command within 24 hours, followed by public disclosure.
• Int 1119-2026 — a city emergency-response plan for AI-model threats to infrastructure and public safety.
• Int 1123-2026 — whistleblower protections for city employees and covered contractor workers reporting specified AI-model safety risks.
• Int 1130-2026 — advertising disclosure of third-party validation and restrictions on misleading claims about model safety.
• Int 1118-2026 — chatbot data-privacy, security, user-access and disclosure duties.

The September 25 package also includes Int 0161-2026 on reporting workplace effects of city algorithmic tools and Int 0504-2026 on AI depictions of public officials. Council records list both older bills in committee; they are not newly introduced September 25 measures.

Status checked October 9, 2026: the eight numbered bills were introduced October 8 and remain in committee. Their requirements and commencement provisions are proposals. September 25 remains the package’s announcement date.

New York City AI hearing announcement

On September 16, 2026, New York City Council announced an October 5 AI-risk hearing of its Committee of the Whole. Speaker Julie Menin requested participation from OpenAI and Anthropic. See September 16 digest coverage.
